This Privacy Policy is subject to Dessert Pay's End User Licence Agreement (EULA). Unless otherwise stated, this Privacy Policy adopts the definition of terms in the EULA.

INFORMATION COLLECTED. Dessert Pay can collect information from you when you visit Dessert Pay's website; make an enquiry with Dessert Pay; download the App; lodge comments, enquiries or reviews on the on App via the GooglePlay store; and use the App. The personal information that you provide directly to us through the above means will be apparent from the context in which you provide the information. The information Dessert Pay collects constitutes personal information, including your first name and surname; email address in form including first name and surname; Internet Protocol address; cookie identification, physical address and phone number. Dessert Pay also could collect, in aggregate form, information such as gender, device type, and user interests for the purposes of analytics.

USE OF INFORMATION. We rely upon a number of legal grounds to ensure that our use of your personal information is compliant with applicable law. We use personal information to facilitate the business relationships we have with our users, to comply with our financial regulatory and other legal obligations, and to pursue our legitimate business interests. We also use personal information to facilitate payment transactions with Stripe and to provide payment-related services to our users. The use of your information in this way means that your information may at times be transferred to a recipient outside of the European Union or USA.

Any of the information Dessert Pay collects from you may be used in one of the following ways: to personalise your experience (your information helps us to better respond to your individual needs); to improve our website (we continually strive to improve our website offerings based on the information and feedback we receive from you); to improve customer service (your information helps us to more effectively respond to your customer service requests and support needs); to process transactions with Stripe (your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested); to administer a survey or other site feature; to send periodic emails (the email address you provide for order processing, may be used to send you information and updates pertaining to your order, in addition to receiving occasional company news, updates, related product or service information, however if at any time you would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email); and GoogleAnalytics features.

PROTECTION OF INFORMATION. Dessert Pay implements a variety of security measures to maintain the safety of your personal information when you use the App for the Platform Services. We offer the use of a secure server. No Card Details are ever stored by Dessert Pay. The App uses Stripe's mobile Application Programming Interface (API) to encrypt and pass Card Details and Data to the Stripe server where it is securely processed by Stripe's, which is certified to the highest level of PCI-compliance. Your Data and Card Details are further protected by Stripe's Privacy Policy, with which Dessert Pay complies. Dessert Pay holds your personal information for the length of time that you are a user of Dessert Pay. If you cease using Dessert Pay for a period of one year we will take all reasonable efforts to erase all records of your personal information from our possession, to the extent permitted by law.

COOKIES. Dessert Pay uses Cookies. Cookies are small files that a site or its service provider transfers to your computer's hard drive through your Web browser (if you allow) that enables the sites or service providers systems to recognise your browser and capture and remember certain information. Cookies are used by Dessert Pay understand and save your preferences for future visits, keep track of advertisements and compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. We may contract with third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.

DISCLOSURE OF INFORMATION TO OUTSIDE PARTIES. We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include Stripe, or trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

TRUSTED THIRD PARTY AFFILIATIONS. Occasionally, at our discretion, we may include or offer third party products or services on our App or website. These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

CONSENT. By using the Dessert Pay App or website, you consent to our Privacy Policy. Where the processing of your personal information is based on your previously given consent, you have the right to withdraw your consent at any time. You may also have the right to object to the processing of your personal information on grounds relating to your particular situation, depending on your jurisdiction.

YOUR RIGHTS. If you would like to review, correct, or update personal information that you have previously disclosed to us, you may do so by contacting us. f you no longer want to receive marketing-related emails from us, you may opt-out via the unsubscribe link included in such emails. We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages that are required to provide you with our services. If you wish to exercise your data protection rights, contact us with a statement of your request. We will comply with your request to the extent required by applicable law. We will not be able to respond to a request if we no longer hold your personal information. If you feel that you have not received a satisfactory response from us, you may consult with the data protection authority in your country.
